Arbitration & Mediation Cell
Mediation Cell
In India, the justice system is expensive, time-consuming, and complex. Therefore, judiciary, and the Government are focusing more on ADR systems like mediation and arbitration to settle disputes. Unlike arbitration, mediation is a less formal but private dispute resolution process whereby the parties to a dispute participate on a voluntary basis, assisted by a trained and neutral third party called as mediator by the use of specialized communication and negotiation techniques. Over the last 15 years, the dispute resolution landscape in India has undergone significant change with the advent of mediation. Hon’ble Chief Justice of India Mr. N.V. Ramana recently commented that mediation and negotiation should be made mandatory as a part of case management. The Mediation Bill, 2021 likely to be passed in the Parliament, will be a milestone.
